1. Acceptance of Terms
By creating an account or using YVWhatsApp, you agree to these Terms of Service. If you are using the service on behalf of an organization, you represent that you have authority to bind that organization.
2. Service Description
YVWhatsApp provides a platform to send and receive WhatsApp messages via the official Meta WhatsApp Business API. This includes team inbox, broadcast messaging, chatbot automation, contact management, and analytics features.
3. Account Responsibilities
You are responsible for maintaining the security of your account credentials, all activity under your account, ensuring your WhatsApp Business API usage complies with Meta's Commerce Policy and Business Messaging Policy, and obtaining proper consent before messaging contacts.
4. Acceptable Use
You agree not to: send spam or unsolicited messages, use the platform for illegal activities, violate Meta's WhatsApp Business Policy, attempt to reverse-engineer or exploit the platform, share your account credentials with unauthorized parties, or exceed your plan's usage limits.
5. Pricing & Billing
Plans can be billed monthly or yearly. The Basic plan is ₹999/month. The Pro plan is ₹1,999/user/month, or ₹1,499/user/month when billed yearly, with additional users at ₹500/user/month. Enterprise pricing is custom. All prices are exclusive of applicable taxes. You can cancel anytime — no refunds for partial months.
6. WhatsApp API Compliance
You acknowledge that WhatsApp message delivery is subject to Meta's policies and infrastructure. We are not responsible for message delivery failures caused by Meta's systems, recipient blocking, or policy violations on your part.
7. Data & Privacy
Your use of the service is also governed by our Privacy Policy. We process your data as described therein. You retain ownership of your message content and contact data.
8. Service Availability
We target 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance. We are not liable for downtime caused by third-party services (Meta, cloud providers).
9. Limitation of Liability
To the maximum extent permitted by law, YVWhatsApp's total liability is limited to the amount you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
10. Termination
Either party may terminate at any time. Upon termination, your access to the platform will be revoked. Your data will be retained for 30 days after termination, after which it will be permanently deleted.
11. Changes to Terms
We may update these terms from time to time. Material changes will be communicated via email. Continued use after changes constitutes acceptance.
